Details on documentation for access to the Grandchildren's Law, according to the Spanish Consulate in Puerto Rico

Consulate General of Spain in San Juan, Puerto Rico: Documentation and Procedures for the Democratic Memory Law or the Law of Grandchildren. Updates, according to this Iberian office in the Puerto Rican capital.

El Consulate General of Spain in San Juan, Puerto Rico reported on the requirements and documentation necessary to apply for Spanish nationality under Additional Provision 8 of Law 20/2022, of October 19, known as the Democratic Memory Law (LMD).

To apply for Spanish citizenship under the Grandchildren Law in Puerto Rico, the following documentation is required: original and two copies:

  • Completed and signed application.
  • Literal birth certificate of the applicant, translated into Spanish if applicable, and duly legalized with the Hague Apostille or the Seal of the Ministry of Foreign Affairs from the country of issue.
  • Literal birth certificate of the interested party's father and mother, issued by a Spanish civil registry if they were born in Spain. If they were born abroad, it must be translated and legalized with the Hague Apostille.
  • Marriage certificate of parents, translated if applicable, and legalized according to the country of origin.
  • Valid passport. In the case of women with a married name, a marriage certificate must also be presented.
  • Certification of tax return filing in Puerto Rico, which proves residence in the consular district.

Additional Documentation. Grandchildren Law in Puerto Rico

If the applicant has a Spanish grandparent (Annex I):

  • Literal birth certificate of the Spanish grandparent, issued by the Spanish civil registry or, failing that, a baptismal certificate and negative certification from the civil registry.
  • Declaration of Nationality 1899-1900 (General Archive of Puerto Rico).

If the applicant has a Spanish parent (Annex III):

  • Literal birth certificate of the Spanish father or mother, issued by a Spanish civil registry or the corresponding Consulate.

Forms to Complete

  • Data declaration sheet for birth registration.
  • Annex I or Annex III, as the case may be.
  • Annex V.
