Cuban government warns against illegal use of Starlink to connect to the Internet

The Cuban government issued a serious warning about the unauthorized use of the Starlink satellite internet service in its territory, describing it as illegal and contrary to Radio Regulations of the International Telecommunication Union (ITU).

This position is based on three fundamental aspects, according to the officialdom in a post Facebook's, first, unauthorized use of radio spectrum, lack of operating license and violation of national legislation, such as Resolution 272 / 2015.

According to the ITU, each country has complete sovereignty over its Radioelectric spectrum and must coordinate with satellite providers the use of frequency bands such as Ku and Ka. Starlink, by operating without permission from the Cuban Ministry of Communications, violates these regulations and represents a clear case of unauthorized interference.

In addition, by not having a official license nor notified its activity to the ITU, SpaceX would be engaging in a practice that has already been reported in other countries, such as Iran, where the ITU supported the state's position regarding the illegal operation of the system.

The Cuban government also noted that national legislation expressly prohibits the importation and use of satellite equipment, including Starlink terminals, without prior approval.

This exposes users to penalties such as confiscations, fines and technical blocking of the Starlink Internet service in Cuba.

Although the ITU has no coercive power, it could issue a symbolic resolution that would affect the international reputation of SpaceX.

So the use of Starlink in Cuba not only violates national laws, but also represents a violation of international principles of sovereignty and spectrum coordination.

Previously, Cuban-American politicians have reported that they are in talks with Elon Musk to provide the island with this system in cases of Internet outages "planned" by the government.
