In recent days, Cubans with I-220A status have been registered as receiving interim parole from ICE. This status has been granted to the fortunate few so far without having requested it. With this document, those who already have parole orders will be able to apply for the Cuban Adjustment Act.
The lawyer and expert in immigration issues, José Guerrero, referred to the topic in statements published on the Facebook profile of Univision. "So far, there's no official government directive on who will be granted it and who won't. Nor is it known what criteria or guidelines the authorities are following for issuing such a document."
"This is tremendous news for those who have received this document. It's a 180-degree change because they'll now be able to prove they have Parole," Guerrero said.
Parole with retroactive effect
Many people have already received this interim parole retroactively. In other words, it was issued to them based on the date they arrived in the United States. However, for others, the opposite is true: they receive the document with the current date. In both cases, this is excellent news for the thousands of Cuban migrants currently residing in the United States.
"It doesn't matter; even if it's not retroactive, you'll still be able to apply for residency. If you didn't apply, you'll still meet the parole requirement for residency under the Cuban Adjustment Act," the lawyer explained.
ICE has the authority to issue this type of document. This is not fraudulent; it's entirely real and positive for those who benefit from this interim parole. More Cubans are expected to receive this new status from the federal agency in the coming days.
This ICE initiative comes one month after the Supreme Board of Immigration Appeals made a significant decision. It rejected the option of considering Form I-220A as a document through which one can access legal immigration status in the country.
