A Boston judge has blocked the Trump administration from suspending humanitarian parole programs for migrants from several countries.

Court order halts parole suspension

Judge Indira Talwani ordered the Department of Homeland Security on Wednesday to resume processing applications under humanitarian parole programs. The measure benefits people from Cuba, Venezuela, Haiti, Nicaragua, Afghanistan, and Ukraine who enter the United States with the support of sponsors.

The decision responds to a class-action lawsuit challenging the legality of the suspension imposed by the current administration. The judge made it clear that, although the executive branch can direct immigration policy, it must respect the formal processes established by law.

The Trump administration attempted to eliminate the program without individual evaluation

Since returning to the White House in January, Donald Trump ordered the DHS to cancel all parole programs established under Joe Biden's administration. The government argued that such temporary permits should be evaluated on a case-by-case basis and not through collective schemes.

Furthermore, the new decree prohibited agencies from accepting new applications or processing immigration adjustment requests from those already approved under parole. It also prevented beneficiaries from accessing protections such as asylum or TPS.

The judge had already blocked another similar decision in April.

Talwani, appointed during the Obama administration, had already blocked a previous attempt to eliminate the temporary legal status of hundreds of thousands of migrants. Now, her new order prevents any changes while the class-action lawsuit proceeds, meaning CHNV and similar programs must continue to operate.

The Trump administration responded with an appeal to the Supreme Court, seeking to overturn the ruling and resume mass deportation plans. The White House harshly criticized the court's intervention and reaffirmed its intention to impose stricter border controls.

The ruling benefits migrants who have already been admitted under parole and those awaiting a response. It also ensures that they can continue applying for other legal benefits while their situation is resolved, without the immediate fear of losing their status or being deported.

Pro-immigrant organizations celebrated the ruling as a temporary victory. They warned, however, that the risk remains if the Supreme Court accepts the government's appeal.

What is humanitarian parole and why is it crucial for thousands of migrants?

Humanitarian parole allows temporary entry into the United States for reasons of humanitarian urgency or significant public interest. It was created during Joe Biden's presidency and has benefited more than 530.000 people from countries experiencing political or economic crises.

Beneficiaries receive an entry permit by plane and authorization to legally reside and work for two years. However, this status is fragile and can be revoked if immigration policy changes.

What can happen now with the Cubans and other beneficiaries?

In the case of Cubans, more than 110.000 people have entered the United States through this program. Many were in the process of adjusting their status or requesting additional protection when the suspension was ordered. Judge Talwani's decision prevents their cases from being dismissed without legal review.

"My son has an appointment in June, and we thought everything was lost. This news has given us a new lease on life," commented a Cuban woman from Hialeah.
