A criminal record is created through a final judgment issued by the court system, which includes custodial and subsidiary penalties, except for fines of less than 200 installments and warnings. Other convictions create a criminal record.
A criminal record clearance is a certificate that proves the absence of a criminal record or, where applicable, the existence of one.
In Cuba, the Criminal Record Registry Offices, an entity attached to the Ministry of Justice of the Republic of Cuba, issue certificates stating whether or not a citizen has a criminal record.
The Ministry of Justice in Cuba is the entity responsible for performing three primary functions: registering, certifying, and canceling citizens' criminal records.
Criminal record certificates are absolutely legal documents and therefore constitute a guarantee under national and international laws. Criminal record certificates, in turn, can be legalized by the Ministry of Foreign Affairs to be valid outside the country.
There are five categories of criminal records. A criminal record certificate is extremely important for national criminal records. It is a personal application and requires only the presentation of an identity card and a five-peso stamp. It must be processed at at least one of the designated offices in each province.
Regarding the expungement of criminal records, there are three types: ex officio, at the request of a party, and extraordinary. The first is the responsibility of the Director of the Central Registry, and the others are the responsibility of the Minister of Justice.
Online criminal record certification request
El Ministry of Justice of Cuba, on its website, offers the service of requesting criminal record certificates, last will and testament, and declaration of heirs.
All applications that can be submitted through this channel include the provincial capitals and the municipalities of Artemisa and Mayabeque.
In the case of Last will and testament and declaration of heirs, applicants must present a death certificate and two stamps worth five pesos each.
For requests for criminal record certification, users who apply online have 72 business hours to receive the certification at the corresponding unit and must bring a stamp worth five pesos in national currency to collect the criminal record certification.
In the case of applications for procedures to be effective abroad, they are processed through the International Legal Consultancies of the province of residence.
Criminal record certifications for Cuban or foreign citizens, for purposes outside the country, are only available at the branches of the civil service company "Consultoría Jurídica Internacional SA." Outside of Cuba, they are available through the island's consular offices abroad.
