Miami lawyer explains key decision on humanitarian parole

In recent hours, the decision by federal judge Indira Talwani has been making headlines among Cubans who entered the United States on humanitarian parole.

Talwani decided that the Donald Trump administration cannot end the legal status of beneficiaries of the program. In this regard, Miami-based immigration attorney Rosaly Chaviano offered clarification on her social media channel. YouTube

The expert noted that with the order, "the revocation of parole will be blocked." "We know that the notice published in the Federal Register affects several things: number one, the termination of the program; number two, the revocation of parole, the work permit, and what they were talking about in terms of these detention and deportation priorities," she added.

According to Chaviano, the judge's order is blocking the revocation of the legal status granted by the parole. This does not mean that the termination of the program itself has been suspended, he clarified. 

Work permits for parole recipients remain valid.

He also explained that the notifications parole beneficiaries received through their USCIS accounts are also "suspended, blocked, and therefore have absolutely no effect." This is good news because it means these migrants' work permits "remain valid."

The lawyer noted that the judge's order is temporary, "not a final order." Therefore, a final decision could be expected in the coming months. However, she stated, "At least the people who were affected by the April 24 decision can breathe and sleep peacefully."

Important clarification: According to Chaviano, this suspension of parole revocation applies to those whose parole wasn't due to expire. That is, if your parole expired, for example, last month or even today, this order would no longer apply to you. It only applies to those whose parole was still valid after April 24.
