Democratic Memory Law: The most important thing now is to submit the credential application, says expert 

In a recent live YouTube broadcast, Estela Marina, an expert on foreigners and immigration, offered important details about the new directive on the Democratic Memory Law and its implications for the descendants of Spaniards. 

 

He noted that the current situation is urgent, especially for the community of descendants in Cuba, where administrative delays and complications arising from the country's crisis are affecting the ability to obtain the credentials necessary for the nationality process.

Estela Marina he highlighted The community of descendants in Cuba is facing serious difficulties due to factors such as power outages, the impact of the hurricane, and recent earthquakes, which further aggravate an already complicated situation. The lack of services and general instability have increased anxiety among applicants, who fear losing their opportunity to obtain Spanish nationality. 

Cuba: Delays in issuing credentials are between 10 and 18 months

The expert emphasized that delays in granting credentials are between 10 and 18 months. This adds pressure to families who want to take advantage of this legal opportunity before the October deadline. 2025.

"The most important thing now is to submit the credential application," he stated in his broadcast. He emphasized that even though the wait may be long, those who haven't submitted their application will be excluded from the law. "If you've already submitted the PDF correctly, even if you don't receive an immediate response, you're already in the system," he added.

The keys to the new instruction from the Ministry of the Presidency: LMD and Spanish nationality

On November 11, the Ministry of the Presidency, Justice and Relations with the Courts issued a new instruction which modifies the previous guidelines of October 25. 

Estela Marina explained that this new instruction has two key points that benefit applicants:

  • Section 1B of the new instruction allows interested parties to submit their application even if the appointment is not attended within the stipulated period. This applies as long as the application was submitted through online tools that guarantee the applicant's identity. "Sending the PDF is sufficient to be protected within the legal framework," he explained. 
  • According to Section 1C, the deadlines for corrections, that is, corrections that can be made to documents, also apply to applications submitted online. This ensures that, even if the process is slow, applications are addressed in a timely manner.

The importance of sending the PDF

The key, according to Estela Marina, is submitting the PDF. When an applicant submits the document correctly, even if there is no immediate response, it is already in the system and their application will be processed. "Even if it takes years to respond, your application is registered and you will have the right to be served," commented Estela, who also emphasized that those who do not submit their documentation correctly will be excluded from the process.

He also reminded everyone that the time to take advantage of this opportunity is limited. "Time is running out in October," 2025After that date, there will be no further extensions. If this isn't achieved before then, only a reform of the Civil Code could open up new opportunities, but that won't happen in the short term.

  1. What happens to people who submitted in 2010, and due to an error in the data sheet, they marked an x ​​incorrectly and the process lasted until 2019? All the corrections that were needed were submitted, but in this case, they never noticed the error.

They denied it on 25/3/2019 and I wrote down the reasons in my statement, that I should leave my mother's box empty. In short, nine years in that process, and the literal certification from my grandfather sent from the Coruña registry was of no use.
