Procedures for the purchase, sale, donation, and exchange of homes

According to Decree-Law No. 288/2011 amending Law No. 65, of December 23, 1988, General Housing Law

Documents that must be submitted to the notary:

■ Identity Document.

■ Official document proving ownership of the property.

■ Proof of registration of the property in the Property Registry of the municipality where the home is located.

If the property is owned by a married couple or the buyer is married, both spouses must appear. Voluntary representation is permitted through a special power of attorney or legal services contract signed with a lawyer from Bufete Colectivo, provided it is appropriate and one or both parties are unable to attend the hearing.

Also in case of sale:

■ Document from the bank branch proving the total settlement of debts for the transfer of ownership.

■ The buyer will present the cashier's check issued by the bank branch, proving the deposit of the money agreed upon by the parties, which will expire sixty (60) days from the date of issue.
Exchanges intended for the municipalities of Old Havana, Central Havana, Cerro, and Diez de Octubre from any other municipality must be authorized by the Notary Office corresponding to each of the aforementioned municipalities. If the exchange involves housing located in these municipalities, the above procedure will apply.

The notary will advise any other particular matter, taking into account that not all cases are the same.

In contracts for the sale of homes and motor vehicles, the actual sale price must fully coincide with the price declared by the parties in the public deed.

CONTRACTS TRANSFERRING OWNERSHIP OF HOUSING AND MOTOR VEHICLES CAN BE VOIDED IF A DONATION IS SIMULATED BY A PURCHASE AND SALE.
