Some of the most in-demand notarial services in Cuba are those related to the legalization of housing transactions. These include the process before a notary public to legalize the unification or division of a dwelling, as well as the process for the legal formalization of the transfer of use of a roof terrace for construction projects such as building or expansion of a property.Housing unification is the act by which the owners of two properties that adjoin or are located above each other and are inhabited by people who wish to live together, proceed to connect them together, taking them as a single dwelling, thus giving rise to legal co-ownership.
The housing unification process requires that interested parties submit the following documents to a notary public:
- Property owners must present their identification documents
- Title Deeds of the homes
- The Technical Opinion granted by the Municipal Directorate of Physical Planning, where the two houses are described, and the house that results from the unification of these
- If the properties are previously registered in the Property Registry, they must present a Certificate of Registration.
The division of a home is the act by which the owners of a home, when the structure of the building allows it, with the prior granting of the corresponding construction license, wish to liquidate the legal co-ownership.
The process of dividing a home requires that interested parties submit the following to a notary public:
- Homeowners must present their identification documents
- Title Deeds of the homes
- The Technical Opinion granted by the Municipal Directorate of Physical Planning, where the original housing and the housing resulting from the division are described
- If the properties are previously registered in the Property Registry, they must present a Certificate of Registration.
The transfer of use of a roof for construction projects such as the construction or extension of a home is the act by which the owners of a home grant a third party the right to extend or build a home on the roof of the building.
The rooftop transfer process requires submitting to a notary public:
- Identity documents
- Title of Ownership of the property whose roof is being transferred
- Authorization resolution granted by the Provincial Directorate of Physical Planning
- These constructive actions are formalized before a notary public, granting them legal validity.
